TERMS & CONDITIONS OF HIRE & USE

1. Acceptance & Confirmation
This form must be signed by the hirer before goods will be dispatched/picked up. Identification must be presented and details taken. If you are hiring on behalf of a business or organisation you confirm that you are authorised to enter this contract on behalf of that organisation or business and that you indemnify us against all losses and expenses which may be incurred if this is not the case. Darwin Backline reserve the right to decline some or all of your order at the discretion of us.

2. Payment & Prices Terms
Full payment is required by cheque, EFT, Cash or Credit Card in advance of hire. This payment confirms acceptance for production or delivery to commence on the schedule date of request. Should payment not be received, Darwin Backline reserves the right to withdraw from the accepted agreement and accepts no responsibility for the non-delivery of goods. A 3% surcharge will apply to the total cost when using Visa or MasterCard. 5% surcharge applies to American Express. If paying by Cheque you must submit payment at least 5 business days before supply of goods. Credit terms may be available at the discretion of Darwin Backline.

3. Delivery / Pick up
An additional charge will be made for delivery/pick up. The rate is 20% of the hire cost with a minimum charge of $50+GST for the Darwin Metropolitan area. POA for costs outside the Darwin Metropolitan area. The hirer will bear responsibility for the equipment from the time of delivery until collection by or return to the owner.

4. Damage or Loss
The hirer shall at all times be liable for the loss of, damage or break down of Darwin Backline equipment. The hirer agrees to notify Darwin Backline immediately of any damages or loss of equipment. The hirer shall be liable for any costs incurred by repairing or replacement of goods. In the event that the equipment breaks down or considered unsafe to use, the hirer must immediately stop utilising the equipment and take all measures to prevent further damage of equipment or prevent injuries to any person or property. No attempts will be made to repair equipment without prior consent from Darwin Backline Management.

5. Cancellation
Refunds do not apply to goods cancelled after supply. Partial refunds and cancellation may be discussed if equipment fails under normal conditions during the hire period.

6. Hire Conditions
You should return all equipment to us no later than 10:00am on the date agreed upon and all equipment should be in the same condition it left us. The hirer is liable for all cleaning/repair/ maintenance costs incurred due to issues over the course of the hire. Darwin Backline retains the right to alter, vary or substitute any items without notice and to remove goods at any time if the items are considered to be being mistreated or not utilised for the purpose for which they are designed. All hire goods (namely equipment hire, prop items and display panels) remain the property of Darwin Backline at all times. The hirer shall at all times be liable for the wilful loss of, or damage to the owner’s (Darwin Backline Pty Ltd) hire & prop equipment from whatever cause, from the time it arrives on site to the time it returns to the Darwin Backline warehouse. All fascia signage remains the property of Darwin Backline Pty Ltd and must remain with the exhibition stands for collection by our staff after the event. Setup/delivery, and/or freight outside the local Darwin area will incur extra charges. A valid credit card must be presented upon pickup for security purposes. Darwin Backline has the right to utilise this payment method for item damage, loss or late return.

7. Privacy Policy
This document is confidential and must not be shown to parties not directly related to this project without written agreement from Darwin Backline Pty Ltd.

8. Release & Indemnity
The Hirer hereby releases Darwin Backline Pty Ltd from, and agrees to indemnify Darwin Backline Pty Ltd in respect to any third party claims, actions, suits, demands, costs and expenses for damage or injury to a person or property arising directly or indirectly out of the hire or use of the equipment by the Hirer or this agreement.
